Highlights: PA PUC Public Session of January 26, 2007

At the January 26, 2007 Public Meeting of the Pennsylvania Public Utility Commission (“Commission”), the Commissioners adopted Staff’s recommendations for action by a vote of 4-0 on all items listed on the Main Agenda and Carry-In Agenda, except as reflected herein below under the respective Commission agenda headings. Review of particular items addressed by the Commissioners at this Public Meeting which may be of interest are also addressed under the respective Commission agenda headings below. Any relevant motions and statements are attached to the original of this Session Memo filed in the Public Meeting Agenda and Session Memo binder. The next regular Public Meeting is scheduled for Thursday, February 8, 2007 at 10:00 a.m. The minutes of the Public Meeting of December 21, 2006 were unanimously approved without modification.
CASES OF SPECIAL INTEREST
- PA PUC v. PPL Gas Utilities Corp., OSA-0026*, R-00061398, et al. Supplement No. 11 to Tariff Gas-Pa. P.U.C. No. 3, to become effective July 1, 2006, containing proposed changes in rates, calculated to produce $12,813,000 in additional annual revenues. By Commission Order entered June 22, 2006, the filing was suspended to February 1, 2007. ALJ Jones, in her Recommended Decision of December 8, 2006, found that the Company’s proposed Tariff should be rejected. PPL Gas voluntarily postponed the effective date to February 9, 2007. Several Parties filed Exceptions and Reply Exceptions to ALJ Jones’ December 8, 2006 Recommended Decision. Staff recommended that the Commission conduct a Non-Binding Poll of the issues involved in this proceeding. The Concurring and Dissenting Statement by Vice Chairman Cawley is attached. The Final vote will take place at the Public Meeting of February 8, 2007.

- Pymatuning Independent Telephone Company and Verizon Pennsylvania Inc., OSA-0004*, A-312800F7000. Joint Petition filed on November 30, 2006, for Approval of an Interconnection Agreement. No Comments have been received. Staff recommends that the Commission adopt the proposed Opinion and Order granting the Joint Petition. Vote of 4-0 with no discussion.
- Sprint Communications Co., L.P., OSA-0025*, A-310183F0002, et al. Application for Approval of the Right to Offer, Render, Furnish or Supply Telecommunications Services as a Competitive Local Exchange Carrier. Petition for Clarification filed by Sprint on December 18, 2006. Staff recommends that the Commission grant the Petition, consistent with the proposed Opinion and Order. Vote of 4-0 with no discussion.

Office of Administrative Law Judge
- Binta Diallo v. PGW, ALJ-0100*, C-20066218. On April 12, 2006, a complaint was filed alleging a billing dispute. On May 5, 2006, PGW filed its answer. A hearing was held on June 28, 2006. Staff reviewed ALJ Fordham’s Initial Decision sustaining in part with respect to the late payment charges assessed, and otherwise dismissing the complaint. Vote of 4-0 with no further discussion with Vice Chairman Cawley concurring in result only.
- Susan H. & Edward Schmidt v. Dominion Retail, Ind., t/a Peoples Plus, ALJ-0102*, C-20066726. On August 16, 2006, a complaint was filed alleging Dominion failed to provide complainant with an opportunity to shop for an alternate supplier, and that Dominion did not send complainant notice of the new contract rates until three weeks before complainant’s contract expired. On September 13, 2006, Dominion field its answer. No hearings were held. Staff reviewed CALJ Smith’s Initial Decision dismissing the complaint. Attached is the Motion of Vice Chairman Cawley advising that the Initial Decision be reversed consistent with this Motion, the case be remanded to the OALJ for hearing and a decision, and that the OSA prepare the appropriate Opinion and Order consistent with this Motion. Vote of 4-0 with no further discussion.
- Margaret Ann Frazier v. Cleartel Telecommunications Inc., ALJ-0103*, F-01949334. On June 5, 2006, a complaint was filed alleging a billing dispute. Cleartel did not file an answer to the complaint. A hearing was held October 18, 2006. Staff reviewed ALJ Nguyen’s Initial Decision dismissing the complaint with prejudice. Matter was postponed until the Public Meeting of February 8, 2007.

Staff recommends that the Commission grant the Petition, pending review of and consideration on the merits. Vote of 4-0 with no discussion.
- AT&T Communications of PA, Inc. v. Verizon North Inc. and Verizon PA Inc., OSA-0028*, C-20027195. Petition for Reconsideration of the Commission’s Opinion and Order entered January 8, 2007, filed by Qwest Communications Corporation. Staff recommends that the Commission grant the Petition, pending review of and consideration on the merits. Vote of 4-0 with no discussion.
