Highlights: PA PUC Public Session of March 13, 2008

At the March 13, 2008 Public Meeting of the Pennsylvania Public Utility Commission (“Commission”), the Commissioners adopted Staff’s recommendations for action by a vote of 4-0 on all items listed on the Main Agenda and Carry-In Agenda, except as reflected herein below under the respective Commission agenda headings. Review of particular items addressed by the Commissioners at this Public Meeting which may be of interest are also addressed under the respective Commission agenda headings below. Any relevant motions and statements are attached to the original of this Session Memo filed in the Public Meeting Agenda and Session Memo binder. The next regular Public Meeting is tentatively scheduled for Thursday, March 27, 2008 at 10:00 a.m. The minutes of the Public Meeting of February 14, 2008, were unanimously approved without modification.
CASE OF SPECIAL INTEREST
- PA PUC v. Pennsylvania Power Company, OSA-0104*, P-00072305. Petition for approval of an Interim Default Service Supply Plan regarding procurement of supply for the residential class. The issue of default supply procurement for the residential class was remanded to the ALJ for further Hearings, which were held February 26, 2008. The Parties filed Main Briefs and an Order certifying the record of the Remand Proceeding was issued by ALJ Nene. Staff recommends that the Commission adopt the proposed Opinion and Order addressing the issues involved in this proceeding. The Statements by Chairman Holland and Vice Chairman Cawley are attached, as well as the Dissenting Statement by Commissioner Christy making the vote 3-1 with Commissioner Christy dissenting.

Office of Special Assistants
- Susan K. Pickford, et al v. Pennsylvania-American Water Company (Service issue), OSA-0084*, C-20078029 et al. In September 2007, twenty-three Formal Complaints were filed by customers of PAWC, protesting PAWC's proposal to convert its West Shore Regional Water Treatment Plant and its Silver Springs Water Treatment Plant from chlorinated water to chloraminated water. PAWC filed Preliminary Objections. By her Initial Decision issued October 5, 2007, ALJ Chestnut granted PAWC's Preliminary Objections and dismissed the Complaints. Various Exceptions were filed. Reply Exceptions were filed by PAWC on November 5, 2007. Staff recommends that the Commission adopt the proposed Opinion and Order that denies the Exceptions and adopts the ALJ's Initial Decision. Motion by Chairman Holland as well as the Concurring Statement by Vice Chairman Cawley and the Joint Statement by Commissioners Pizzingrilli and Christy are attached. Vote of 4-0 with Commissioners Pizzingrilli and Christy concurring in result only.
- PA PUC, LBPS v. Redevelopment Authority of Luzerne County, (Non-compliance of Commission Orders) OSA-0085*, C-20054555. On April 21, 2005, Prosecutory Staff filed a Complaint alleging that the Authority had failed to comply with previous Commission Orders and also requested that a penalty be imposed. On June 4, 2007, the Recommended Decision of ALJ Jandebeur was issued recommending that the Complaint be denied and dismissed. Prosecutory Staff filed Exceptions on June 25, 2007, as did PennDOT. The Authority filed Reply Exceptions to the Exceptions of each Party on July 3, 2007. This matter was postponed until Public Meeting of March 27, 2008.
- PA PUC, BTS v. Bud Transport, Inc., (Code and Regulation Violations), OSA-0259*, A-00111684C0601. By Initial Decision issued May 29, 2007, ALJ Nemec sustained in part and denied in part the Complaint and ordered Petitioner to pay a civil penalty within twenty days after service of the Commission Order. The Petition to Modify Commission Order was filed on August 22, 2007. Staff recommends that the Commission deny the Petition, consistent with the proposed Opinion and Order. Motion of Commissioner Pizzingrilli is attached. Vote of 4-0 with no further discussion.
Bureau of Fixed Utility Services
- Denver and Ephrata Telephone and Telegraph Company d/b/a D & E Telephone Company, 2020496-FUS-0002, R-2008-2020496. Boundary Modification filed January 28, 2008, through Supplement No. 268, to Tariff Telephone-Pa. P.U.C. No. 15, to become effective March 28, 2008. Staff recommends that the Commission adopt the proposed Order. Vote of 4-0 with no discussion.
